After spending 60 years of trade in India, the East India Company
was facing the problem of Control over the Englishmen
who were not the workers of Company but they were trading in Indian Territory and also residing in British Colonies. The British king Charles II realised the weak condition of Indian rulers. He realised that the growth of income of the company depended on the legal adjudication system.
In view of the above issues, the charter of 1661 had been issued on April 03, 1661. It was the first step to establish a judicial Court in British India. The charter entrusted law making power into the company.
With the implementation of the charter of 1661,
the company empowered itself to appoint the
Governor and Council to decide civil and criminal cases of all persons in the Company.
The Governor and his council received
general judicial authority to judge all persons belonging to the jurisdiction of the said Governor and company or that shall live under them in all cases, whether civil or criminal according to the laws of the United Kingdom and to execute judgment accordingly. The Charter of 1661, issued by King Charles II, transformed the East India Company from a basic trading association into a governing body with military and judicial powers.
